SIGLER CARTAGENA 2027

General Terms of Use, Booking, and Purchase

Last updated: November 1, 2026

Relationship of the Parties

Sigler is the visible identity of the event. ICM Travel is the agency engaged by Sigler to organize it. MACONDO DMC S.A.S. directly offers optional activities to attendees and is responsible for the sale, booking, payment collection, and operation of the services purchased through this portal. All such purchases are made directly from Macondo.

1. Service Provider Identification and Acceptance

MACONDO DMC S.A.S., Tax Identification Number (NIT) 900486915-4, domiciled in Bogotá, D.C., at Carrera 15 A No. 112-62, Edificio Urban Atenea, email siglertours@macondodmc.com, and National Tourism Registry No. 26194, is the local provider and operator of the optional activities offered through this portal. By using the portal or completing a purchase, the user represents and warrants that they are at least 18 years of age and agrees to be bound by these Terms, the Privacy Policy, the specific conditions applicable to each activity, and the cancellation policy displayed prior to payment.

2. Purpose, Scope, and Portal Users

The portal allows adult attendees of the Sigler Cartagena 2027 event and their adult companions to browse, book, and pay for optional activities. It is not intended for minors, and bookings for people under 18 years of age are not permitted. The activities are available for purchase during the sales windows established for each event group. On-site sales made by authorized Macondo personnel may use the same system, with different rates or conditions disclosed before payment.

3. Purchases for Other Adults

The purchaser may make a booking for themselves or on behalf of other adults. By providing another participant’s personal data, the purchaser represents and warrants that they are authorized to provide such data, have informed the participant of the applicable terms and conditions, and that all information provided is accurate. The purchaser will remain the primary contact for the booking unless otherwise confirmed in writing by Macondo.

4. Activity Information

Each activity listing provides the information available for that activity, including, as applicable, its description, shared or private format, available dates and times, duration, meeting or pickup point, minimum and maximum number of participants, language, inclusions and exclusions, and documentation requirements.

For certain water-based tours, the port authorities and the operating provider require each participant’s full name, date of birth, age, passport number, and passport expiration date. Photographs are for illustrative purposes and do not replace the service description.

5. Availability and Booking Confirmation

Adding an activity to the cart does not reserve space or guarantee availability. A booking is confirmed only when payment is approved, the system generates a confirmation code, and the purchaser receives confirmation on screen or by email. If a discrepancy involving availability, price, discount, date, time, or system integration prevents confirmation of the service, Macondo will contact the purchaser to offer an alternative, correct the order, or refund the applicable amount.

6. Accuracy of Information and Correction of Errors

Before making payment, the user must review and verify the names, email address, telephone number, selected activity, date, time, service format, number of participants, pickup point, and total amount. Any errors must be reported immediately to siglertours@macondodmc.com. Any changes requested will be subject to availability, the applicable conditions of the activity, and any resulting price difference. Macondo reserves the right to correct any obvious publication, pricing, or configuration errors before the booking is confirmed. If payment has already been made, Macondo will notify the purchaser and offer the option to confirm the booking under the corrected conditions or receive a refund of the amount paid.

7. Prices, Currency, Taxes, and Currency Conversion

Prices are displayed before payment, together with any applicable discounts, taxes, and mandatory charges. The portal displays prices in U.S. dollars (USD). Before the payment is processed, the final amount and the currency in which the charge will be made will be disclosed. The card issuer may apply additional charges in accordance with its own terms and conditions.

8. Discounts and Promotions

Advance-purchase discounts, price codes, and other promotions are subject to specific dates, availability, and conditions. They may not be combined unless expressly stated. The price displayed and accepted at checkout will apply to the confirmed order. On-site sales rates may differ from advance-purchase rates.

9. Payments and Security

Payments are processed through ePayco. Payment approval is subject to the payment gateway, payment networks, and the purchaser’s financial institution. Macondo does not store full payment card details. A declined, pending, or incomplete transaction does not confirm a booking. The transaction will appear on the purchaser’s bank or card statement under the merchant name MACONDO DMC S.A.S. Duplicate payments, unrecognized transactions, or payment discrepancies must be reported to siglertours@macondodmc.com, together with the payment reference and order code.

10. Payment Reversals, Right of Withdrawal, and Statutory Refunds

Requests for payment reversal due to fraud, an unauthorized transaction, nonperformance, or other legally applicable circumstances will be handled in accordance with Colombian law and the procedures followed by the entities participating in the payment process. The right of withdrawal and its exceptions apply in the cases provided by law, taking into account the nature and scheduled date of the travel service. Refunds arising from the valid exercise of the right of withdrawal in an e-commerce transaction will be made within the maximum period established by law. This section does not replace the commercial cancellation policy accepted at checkout.

11. Cancellation Policy

The following cancellation terms apply to optional activities purchased through the portal:

The order may be canceled at no cost within twenty-four (24) hours after purchase confirmation.

Cancellations requested fifteen (15) calendar days or more before the service date will receive a 100% refund.

Cancellations requested between ten (10) and fourteen (14) calendar days before the service date will receive a 50% refund.

Cancellations requested nine (9) calendar days or less before the service date are nonrefundable.

The request must be sent to siglertours@macondodmc.com and include the purchaser’s name, confirmation code, activity, service date, and reason for cancellation. The request will be deemed received when Macondo confirms receipt in writing.

Changes to the participant, activity, date, or time are subject to availability and the applicable conditions.

12. Refund Timing and Method

Once a refund has been approved, Macondo will process the refund to the same payment method used for the purchase. If a refund to the original payment method is not possible, Macondo will inform the purchaser of the available alternatives. The refund will be processed within fifteen (15) calendar days after its approval and receipt of all required information. The time it takes for the funds to appear in the purchaser’s account may depend on ePayco, the payment network, and the card issuer.

13. No-Shows, Late Arrivals, and Unused Services

Failure to appear at the confirmed place and time, arriving too late to join the activity, or choosing not to use all or part of the service constitutes a no-show. Unless the specific conditions state otherwise or a legally protected circumstance applies, a no-show does not qualify for a refund. Macondo is not responsible for losses arising from incorrect contact information or failure to follow the instructions provided.

14. Minimum Number of Participants and Cancellation by Macondo

Each activity may be subject to its own minimum number of participants, as stated in the activity listing and again before the purchase is completed.

If the required minimum is not met, Macondo may offer to reschedule the service, provide a comparable alternative activity, or issue a full refund of the amount paid for the affected activity. The purchaser may accept or decline the alternative offered.

15. Weather, Force Majeure, and Operational Changes

For safety reasons, weather conditions, sea conditions, road closures, government restrictions, the unexpected unavailability of a provider, acts of third parties, or circumstances beyond reasonable control, Macondo may adjust schedules, routes, meeting points, means of transportation, or other nonessential aspects of the service. If a change materially affects the service, Macondo will offer rescheduling, an alternative, or a refund for the affected service. Nothing in this provision limits any non-waivable consumer rights.

16. Participant Obligations and Conduct

Participants must provide accurate information, arrive on time, carry the required documents, follow operational and safety instructions, respect personnel, providers, other participants, and the places visited, and refrain from unlawful or unsafe conduct. Macondo or the provider may deny or discontinue participation when there is an objective safety risk or a material breach, without prejudice to determining any refund that may be legally due.

17. Accessibility and Conditions of Participation

The portal does not collect sensitive data or medical information. Some activities may involve walking, boat travel, the use of stairs, uneven surfaces, or other conditions inherent to their operation. If a participant needs to confirm accessibility conditions or whether an activity is suitable for the participant’s mobility needs, the participant must contact MACONDO DMC S.A.S. at siglertours@macondodmc.com before purchasing. Macondo will provide the information available about the activity’s conditions without making medical assessments or requesting health information through the portal.

18. Tourism Service Providers and Liability

Macondo may provide services directly or coordinate their provision with guides, transportation companies, boat operators, attractions, and other authorized providers. Macondo is responsible for the obligations that legally apply to it as a provider, operator, or intermediary. Limitations of liability do not apply where they conflict with non-waivable consumer rights.

19. Personal Data Protection

The processing of personal data provided through the portal is governed by the Privacy and Personal Data Processing Policy available in the website footer. The Policy explains what information Macondo collects, how it is used, who may process it, the technologies used by the portal, and the rights of data subjects.

20. Permitted Use of the Portal and Intellectual Property

The user may not interfere with the security of the portal, attempt to gain unauthorized access, use abusive or unauthorized automated processes, introduce malicious content, or make fraudulent purchases. Trademarks, designs, photographs, text, and other content belong to their respective owners or are used with authorization. Sigler is the visible identity of the event, ICM Travel acts as the organizing agency, and Macondo acts as the local operator and direct seller.

21. Customer Service, Claims, and Communications

Questions, requests, changes, cancellations, and claims must be sent to siglertours@macondodmc.com and include the confirmation code and the information required to identify the order. Operational communications will be sent to the registered email address. The user must keep this information current and check the spam or junk-mail folder.

22. Protection of Children and Adolescents

The portal and the activities offered are intended exclusively for adults. In compliance with Laws 679 of 2001 and 1336 of 2009, Macondo advises that the sexual exploitation of children and adolescents is subject to criminal and administrative penalties under Colombian law and maintains a code of conduct against the commercial sexual exploitation of children and adolescents in connection with travel and tourism.

23. Amendments, Effective Date, and Version Retention

These Terms are effective as of November 1, 2026. Material changes will be communicated appropriately and will not apply retroactively to confirmed purchases unless required by law or expressly accepted by the user. Macondo will retain evidence of the version of the Terms accepted by the user, including the date, time, language, and corresponding order.

24. Governing Law and Dispute Resolution

These Terms and the services are governed by the laws of Colombia. The user may submit claims directly to Macondo and may contact the competent Colombian authorities, including the Superintendencia de Industria y Comercio (SIC), where applicable. No provision limits any mandatory consumer-protection mechanism.
